Subletting Your Apartment



How Subletting Works:

 Rules for subletting are defined by your Lease Agreement and our company policies.  Please consult your specific lease.  Terms of subletting your unit are addressed on page two, item 12, of your Residential Lease and on your Rules and Regulations Addendum, item 2.  

 Page two states that you are “(t)o not assign this Agreement nor sublet the Premises or any part thereof without the prior written consent of Landlord.  If Landlord permits an assignment or a sublease, such permission shall in no way relieve Tenant of Tenant’s liability under this Agreement.”  The Rules and Regulations Addendum states “(a)ll subleases must be approved by the Landlord and our formal Sublet Agreement must be used.  A sublet fee per subtenant will be assessed for processing applications, obtaining consent of roommates, lease and sub-lease review, and record keeping.  This fee is due and payable at the time of sublet.  Sub-tenant(s) will be bound by the Sublet Agreement and all terms of the original rental agreement and addenda.”  

 To do this:
  • You need to find a subtenant.
  • Your roommates need to be willing to allow you to sublet. 
  • You need to show your apartment to your potential subtenant and get your roommates approval of the individual. 
  • You will need to have the potential subtenant complete an application.  <Application>
  • You will need to complete a Sublet Agreement with your potential subtenant.  <Sublet Agreement>
  • You will need to review the agreement with your roommates and have your roommates sign the Sublet Agreement.
  • You then need to submit the completed Application and Sublet Agreement to our offices along with the sublet fee.
  • You will then need to wait for our approval before you are allowed to Sublet.
 If you receive our Approval: 
  • Make an appointment for you and your subtenant to go through the sublet agreement and lease in our office.
  • Your subtenant will need to listen to the lease audio tape and review the original lease agreement. 
  • Remember to cancel services to the unit which are in your name and have your subtenant establish service for themselves.
  • Remember to change the name on the mailbox and change your address with the US Postal Service.  <USPS>
  • Give your keys to your subtenant.
  Frequently Asked Questions

  Remember—all damage done to the apartment and all rental payments are YOUR responsibility.  It is YOUR security deposit at stake if the people that you choose to sublet to do not pay rent or damage the premises.
